Following reports in the press today, top divorce lawyer Ayesha Vardag of Vardags, the firm which won for the German heiress Katrin Radmacher in her landmark Supreme Court prenup victory last year, comments:

“We went to the Supreme Court to make prenups work in this country. We did so to give couples the freedom to agree their own arrangements in the event of divorce and opt out of the state default package if they wanted to. The fact that we won that freedom shouldn’t suddenly make it a must for every couple. Kate would not, if they divorced, be entitled to a significant share of historic royal assets. We’re not talking about her walking off with Balmoral. She would get a generous award based on her needs. Sometimes keeping that vague and ducking the issue can be the best option. They have been together a long time through some degree of thick and thin and Kate clearly knows how to behave within the infrastructure she’s signing up to. This may be a case for leaving well alone.”

Ayesha Vardag graduated from Cambridge University with Honours in Law and from Brussels with a Master’s in European Law, working at the International Courts of Justice in the Hague and the UN(IAEA) in Vienna. She then trained and qualified as a finance lawyer at Linklaters London and Moscow on power station and diamond mine projects, before moving on to capital markets work at New York law firm Weil Gotshal & Manges. Ayesha was called to the Bar in 1999 and joined 4 New Square chambers, then crossed to family law at Sears Tooth. She founded Ayesha Vardag Solicitors (www.vardags.com) in 2005.
